TERMS OF USE

ARTICLE 1. SERVICE PROVIDER

5WP Co., Ltd. owns and operates online photo contest and judging platforms, including but not limited to the main website at 5wphoto.com (hereinafter collectively referred to as “5WPhoto”).

ARTICLE 2. ACCOUNT REGISTRATION

Accounts registered on 5WPhoto are intended only for members who share photographs or content they legally own.

Before registering an account to use the services provided by 5WPhoto (hereinafter referred to as the “Services”), you acknowledge that you have read, understood, and agreed to all provisions of these Terms of Use (hereinafter referred to as the “Terms”) by completing the registration process on the 5WPhoto platform.

ARTICLE 3. ACCEPTANCE OF TERMS

By using the Services for the first time, you agree to comply with all terms and conditions stated herein without limitation.

By registering an account and using the Services, you confirm that:

  • All content you share is legally owned by you and does not infringe any copyright, intellectual property, or privacy rights of third parties.
  • 5WPhoto is not responsible for verifying or guaranteeing the authenticity or accuracy of user-submitted content.
  • You agree to comply with all applicable laws and all regulations established by 5WPhoto.

ARTICLE 4. INTELLECTUAL PROPERTY RIGHTS & CONTENT LICENSE

For content protected by intellectual property rights, including photographs (“IP Content”), you grant 5WPhoto a non-exclusive, royalty-free license to use such content on 5WPhoto platforms or related media channels for promotional purposes.

This license automatically terminates when you delete your content or account, except in the following cases:

  • The content has already been shared with others and has not been deleted by them.
  • The content has already been used in media or promotional campaigns prior to deletion.

ARTICLE 5. ACCOUNT NAME & PROFILE IMAGE POLICY

Users may not use account names or profile images that:

  • Violate laws or regulations
  • Promote violence, hatred, discrimination, or harmful content
  • Infringe intellectual property rights
  • Cause confusion with official 5WPhoto platforms, services, brands, or ecosystems without written permission

Accounts violating these rules may be suspended or permanently removed without prior notice.

ARTICLE 6. IMAGE CONTENT POLICY

Users may not:

  • Manipulate or alter photographic works, including misuse of AI technologies, in ways that distort historical facts or defame organizations or individuals
  • Upload violent, pornographic, offensive, or culturally inappropriate content
  • Distribute prohibited or illegal photographic works
  • Violate copyright, related rights, or personal image rights

Users are solely responsible for all submitted content.

ARTICLE 7. PROHIBITED ACTIVITIES

The following activities are strictly prohibited:

  • Unauthorized access, hacking, malware distribution, or system interference
  • Accessing or damaging servers, databases, or service infrastructure
  • Harassing, insulting, or disturbing other users
  • Damaging the reputation of 5WPhoto or its services
  • Unauthorized advertising or commercial promotion
  • Any activity violating applicable laws or regulations

ARTICLE 8. USER RIGHTS & RESPONSIBILITIES

User Rights

Users have the right to:

  • Update or modify personal information and passwords
  • Receive guidance on account security and safe usage
  • Have personal information protected under applicable privacy policies
  • Request support and service-related information from 5WPhoto

User Responsibilities

Users agree to:

  • Provide truthful and accurate registration information
  • Keep account credentials confidential
  • Immediately notify 5WPhoto of unauthorized account usage or security breaches
  • Comply with all applicable laws and platform regulations
  • Accept full legal responsibility for all content shared on the platform
  • Compensate 5WPhoto for damages caused by violations of these Terms or applicable laws

Parents or legal guardians are responsible for supervising minors using the platform.

ARTICLE 9. RIGHTS & RESPONSIBILITIES OF 5WPHOTO

Rights of 5WPhoto

5WPhoto reserves the right to:

  • Suspend or terminate accounts that violate these Terms
  • Remove content, comments, or uploads considered inappropriate or disruptive
  • Cooperate with authorities when required by law
  • Remove user privileges without prior notice in cases of serious violations

Responsibilities of 5WPhoto

5WPhoto will:

  • Support users during service usage
  • Handle complaints and disputes within its authority
  • Protect user information according to applicable privacy laws and platform policies

5WPhoto does not sell or exchange user personal information with third parties except where legally required or otherwise stated in these Terms.

ARTICLE 10. STORAGE & RISK DISCLAIMER

5WPhoto should not be considered a permanent storage service for your photographs or content. Users are responsible for keeping backup copies of all uploaded materials.

When using third-party login services or integrations, your information may be shared with those third parties based on your consent. You acknowledge and accept any associated risks.

5WPhoto shall not be liable for damages caused by force majeure events including but not limited to:

  • Power failures
  • Hardware or software failures
  • Internet disruptions
  • Natural disasters
  • Fire
  • Strikes
  • Changes in law

While we strive to minimize risks, 5WPhoto shall not be responsible for losses arising from such circumstances.

ARTICLE 11. DISPUTE RESOLUTION

These Terms shall be governed by the laws of Vietnam.

Any dispute arising from the use of the Services shall be resolved under the jurisdiction of competent courts in Vietnam in accordance with Vietnamese law.

Complaint Time Limit

Any complaint or dispute within 5WPhoto’s authority must be submitted within two (2) weeks from the date the issue occurred.

Resolution Process

5WPhoto only handles complaints for accounts registered with truthful and complete information.

System records and logs may be used as evidence during dispute resolution.

Unless otherwise required by law, decisions made by 5WPhoto regarding complaints and disputes shall be final.

ARTICLE 12. PERSONAL DATA COLLECTION & PROCESSING

The registration process requires users to provide personal information and passwords.

5WPhoto does not use user information for illegal purposes.

User information may be shared with third parties under circumstances including but not limited to:

  • User consent
  • Third-party login integrations
  • Requests from competent authorities
  • Providing contest-related information to contest organizers

By using the Services, users agree to receive notifications, service announcements, and related communications from 5WPhoto via email, mail, or telephone.

5WPhoto may use user information for research and service improvement purposes.

ARTICLE 13. INTELLECTUAL PROPERTY

All intellectual property rights relating to 5WPhoto services, including copyrights, trademarks, trade secrets, and related rights, belong exclusively to 5WPhoto.

No user may reproduce, distribute, modify, or use any intellectual property belonging to 5WPhoto without prior written permission.

ARTICLE 14. MODIFICATIONS

5WPhoto reserves the right to modify or update these Terms at any time without prior notice.

Updated versions will be published on 5WPhoto platforms.

ARTICLE 15. EFFECTIVENESS

These Terms become effective immediately upon completion of account registration.

If any provision of these Terms is found invalid or unenforceable under applicable law, the remaining provisions shall remain fully valid and enforceable.

ARTICLE 16. PRIVACY POLICY

5WPhoto strives to comply with applicable personal data protection regulations and privacy laws.

However, in cases beyond our reasonable control, 5WPhoto shall not be held responsible for unauthorized access, disclosure, or loss of personal information caused by external factors or force majeure circumstances.
